First chapter General norms |
|
1. |
To allow those children of small ethnic minorities who are living in long term poverty-stricken districts to be able to receive the most basic education, to promote social concern and support educational matters, especially to establish a bursary foundation for the ethnic minorities of Yunnan. |
2. |
The foundation is a social body made up of people from various levels of the social stratum and schools; it is an independent and non-profit organization. |
3. |
The foundation strictly obeys the Chinese constitution, laws, regulations and related policies. It also obeys the moral norms of society. The work is carried out under the direction of the public schools of Hong Kong and Macau, and accepts their supervision and management. |

5. |
The foundation shall have 5 management groups forming a management council, with 1 person as the chief secretary. The foundation’s executive body is the administrative council. If the administrative council is made up of administrative groups, then the administration will be carried out by three parties: both principals of a public school ofMacau, the donations committee, and various people from society at large. If needed, the administrative council can employ specially invited administrative and contact persons. |

The foundation’s chief secretary will carry out the work under the direction of the chief administrator, and the chief secretary will discharge the duties and responsibilities listed below:

Fourth chapter Management and use of assets |

The sources of income of the foundation are:

The foundation’s funds must only be used in accordance with the scope of work and initiatives determined by the constitution. |

The management of the foundation’s funds must be carried out in accordance with the economic system determined, and under the supervision of the administrative council and financial department. |
12. |
The foundation should carry out its plans and accounting in accordance with the law, improve its internal plan for a monitoring system, to ensure that the data for the foundation’s plans is legal, factual, accurate and complete. |

The bursary fund is meant to be used to provide financial aid for those who lost a chance to study due to poverty or for the educational fees of those poor students unable to continue studies, and for the expenditure needed to maintain the minimum standard of living. |
14. |
Donors to the bursary fund have the right to send inquiries to the foundation regarding the use and management conditions of donated capital, and to offer their opinions and suggestions. Regarding the inquiries from donors, the foundation should reply immediately and truthfully. |
15. |
Donors to the bursary fund have the right to choose the recipients of their donations, the right to know the recipients’ basic situation, the right to meet the recipients, and the right to care about their studies and living conditions. |
16. |
The foundation can sign an agreement with the party receiving aid, to fix the method of financial aid, the amount of financial aid, and the purpose and the method of the use of the funds. |
17. |
The foundation has the right to carry out supervision on the situation of the use of financial aid. When the party receiving aid does not use the financial aid according to the agreement conditions or when there are other situations when the agreement is violated, the foundation will have the right to dissolve the financial aid agreement. |
18. |
The foundation will accept the annual inspection organized by the registration and management office according to the stipulations of the “foundation’s management regulations”. |
19. |
After the foundation has undergone the annual check of the registration and management office, it will have its annual work report published on the medium specified by the registration and management office, to accept the general public’s inspection and supervision. |
Fifth chapter Termination and dealing with remaining assets |

20. |
When the foundation accomplishes its aims or voluntarily disbands or needs to be closed down due to reasons of separation or combination etc, the agreement for termination is to be proposed by the secretary to the administrative council and then passed by a vote. |
21. |
Before the foundation is terminated, it has to establish a team to settle the accounts under the direction of the management department of the administrative council, put the credit and debts in order, and deal properly with the related matters. During the period of settling of accounts, it is not permitted to initiate any activities outside of settling the accounts. |
Sixth chapter Additional norms |

22. |
The constitution was passed by a vote by the administrative council on (day, month, year). |
23. |
The right to explain the constitution belongs to the administrative council. |
24. |
The constitution is effective on the day of the self-governing organization’s (administrative council) approval. |
